Trident wins lawsuit over Blizzard settlement

Eros Resources Corp. (now known as Trident Resources Corp.) has partially won a lawsuit in the Supreme Court of British Columbia against its former lawyer, Murray Clemens, for negligently handling a case the company pursued with respect to the expropriation of the Blizzard uranium claims in 2008. Eros said that Mr. Clemens improperly included claims in the expropriation case that Eros did not own. The company later had to make a deal with the owner of those claims so that it could complete the settlement.

The victory for Eros is contained in a judgment released on Thursday, March 19. The judge has ordered Mr. Clemens and his firm, Nathanson, Schacter & Thompson LLP, to pay $2.54-million plus other amounts for interest yet to be calculated. (The interest amounts could be substantial on their own, given that part of the calculation rests on a $28-million amount that was tied up in litigation for over two years.) The decision is only a partial victory, with all amounts reduced by 50 per cent, as the judge has determined Eros contributed to the error.
