The National Post reports in its Wednesday, March 18, edition that Canada's Federal Court ruled that being Facebook friends with a gangster does not constitute a real-world friendship that should impact employment decisions during an RCMP background check. The Post's Adrian Humphreys writes that the court ruling on the effect of social media on real life came after Danielle Capin, 39, failed her security clearance to work in the cannabis sector because of someone she had as a Facebook friend. Ms. Capin applied for a security clearance to work with a legal cannabis producer, as certain jobs in the sector require a background check under the Cannabis Act. Ms. Capin submitted her personal information for a security check in 2022 that confirmed she had no criminal convictions, but was not given security clearance because she had Facebook posts tied to organized crime individuals. Ms. Capin called the decision "outrageous and fallacious" and "grossly unfair." Ms. Capin appealed the denial of her security clearance to the Federal Court. Judge Michael Manson ruled that the decision to refuse Ms. Capin a security clearance was unreasonable. He ordered Health Canada to make a redetermination.
