The Globe and Mail reports in its Monday, March 4, edition that the Bill C-63 aims to create a commission to oversee new rules, an ombudsman who would serve as a citizens' representative and an office to support both. The Globe's guest columnists Emily Laidlaw and Taylor Owen write that the scale and complexity of the issues, the speed through which on-line harm occurs, limitations on access to justice and strained judicial resources demand a different approach. The mandate of the commission also includes education, research and international collaboration on developing best practices. These terms are the building blocks of a good law, but there are genuine issues that warrant further debate. Needing to be resolved are which platforms are needed to be regulated. Bill C-63 does not include private messaging services, gaming and search engines. These are platforms that have facilitated tremendous harm. Their inclusion would create thorny rights problems, such as the risk of breaking encryption and incentivizing surveillance. The guest columnists are hoping we can work together, avoid hyperbole on all sides, and work to make Bill C-63 as effective as possible. The issue warrants it.
