The Globe and Mail reports in its Tuesday, June 2, edition that two years ago, the federal government handed the Competition Bureau the tools it had long requested to help in its campaigns to block takeovers the agency deems to be bad for the country. The Globe's Andrew Willis writes that last month, the watchdog had its first opportunity to wield its newly forged hammer. In early May, the bureau announced it would challenge Keyera's $5.3-billion acquisition of a major NGL business from Plains All American Pipeline based in Houston. The bureau could have used powers gained in 2024, following four years of lobbying by Matthew Boswell and his colleagues, to block Keyera from closing the deal. Lawyers anticipated that the agency would challenge the Keyera acquisition, which would give Keyera and Pembina Pipeline control over the NGL sector in Fort Saskatchewan, Alta. However, the agency, while in the midst of a succession search, challenged the purchase but did not seek an injunction, ultimately allowing the deal to close in mid-May. Plains got its money and exited Canada. Keyera gets to run the combined operations while hearings with the bureau play out, a process that could take years.
