Ordinairy, not special, Canadian citizen, you just go out and block a public road. see how long you last. If you persist, the law will arrest you, you will be dragged away, accordingly charged, and judgement will be appropriately swift.
But, politics must obey politics.
These Natives have no written history to back up their claims of "thousands of years." Try taking your case to court on "word of mouth." " My great great Grampa told me so." You will be immediately laughed out. Politics rules. Cowardly courts rule. Our governments proclaim to all how much they want investment. "Investment creates jobs. Jobs create taxes. Taxes create government social beneficial spending," including spending on and for the Natives, but when the access road is blocked by the Natives, the exact same governments run away and hide in the closet, letting the so much wanted investors hanging high and alone. Is this a joke, ot what???
The whole business is politically smelly. All investors should take their money and invest it somewhere where people and citizens and governments and courts really have enough brains to appreciate the benefits, and that for sure is not in B.C.
Somehow, I seem to think that government social spending and benefits, available from taxation, supplied by investment and jobs, are also actually passed on to the Natives, just like to everyone else, including the ordinairy citizen.
Am I wrong? Are the same Natives, doing their best to stop investment, not willing and able to collect their pound of flesh from the government?? Pretty hairy.

Yes, in contract law the written contract, wins over the oral contract. It is the way it is supposed to work. However, the Supreme Court has conveniently tossed out hundreds of years of precedence.
"The Delgamuukw court case has important implications for the history of Canada and for the idea of history itself. In this case the court gave greater weight to oral history than to written evidence. Of oral histories the court said "they are tangential to the ultimate purpose of the fact-finding process at trial -- the determination of the historical truth."
