The Financial Post reports in its Monday edition that on-line shoppers are likely familiar with the experience of agreeing to buy something at a certain price, only to see costs grow by check-out time. A Canadian Press dispatch to the Post reports that this practice is called drip pricing, which has been deemed unlawful. However, consumers can now fight back against this practice with the help of multiple class-action lawsuits filed in British Columbia targeting the practice. Vancouver lawyer Saro Turner believes that more lawsuits are likely to come. He says: "The average consumer is not a mathematician. Companies that have a significant volume of commerce have to show the price in a meaningful way, not in a deceptive and misleading way." Mr. Turner says the path to the lawsuits was paved by changes to the federal Competition Act in June, 2022, which now explicitly labels undisclosed fees and surcharges that make advertised prices "unattainable" as a "harmful business practice." The amendments mean that Canadians can now launch class actions against companies that advertise unattainable prices. Mr. Turner's firm has drip-pricing cases pending against on-line florist Bloomex, travel site Omio and Cineplex.
