The Globe and Mail reports in its Saturday edition that Boeing has reached a tentative non-prosecution agreement with the U.S. Department of Justice in a fraud case stemming from two fatal 737 Max plane crashes that killed 346 people. A Reuters dispatch to The Globe says the agreement would forestall a June 23 trial date the plane maker faces on a charge it misled U.S. regulators about a crucial flight control system on the 737 Max. The agreement would allow Boeing to avoid being branded a convicted felon and be a blow to families who lost relatives in the crashes and had pressed prosecutors to take the plane maker to trial. A felony conviction also could have threatened Boeing's ability to secure lucrative government contracts with the likes of the U.S. Defense Department and NASA, although it could have sought waivers. DOJ officials are still weighing whether to proceed with a non-prosecution agreement or take Boeing to trial. No final decision has been made, and Boeing and DOJ officials have not yet exchanged papers to negotiate final details of any non-prosecution agreement. The DOJ has concluded there is "meaningful downside risk" to proceeding with a trial after a judge rejected Boeing's previous plea agreement.
