The Globe and Mail reports in its Tuesday, June 10, edition that Ottawa's efforts to regulate Internet streaming services like Netflix and Spotify through the Online Streaming Act have faced legal challenges. The Globe's guest columnist Michael Geist writes that recently, the broadcast regulator completed hearings on Canadian content, but the Quebec government has introduced its own streaming regulation bill, prompting a constitutional challenge. Quebec's Bill 109 proposes government control over content presentation to subscribers. Culture and Communications Minister Matthew Lacombe supports the bill as a way to promote French-language content on global streaming services. The Supreme Court of Canada has ruled that the power to regulate broadcasting falls to the federal government. The key question is whether Internet streaming constitutes broadcasting. If the answer is yes, federal law would apply, potentially rendering the Quebec bill unconstitutional. If Internet streaming is not considered broadcasting, then the federal law might be unconstitutional, but the Quebec bill would remain intact. Overall, it is challenging to reconcile the federal and provincial regulations on on-line streaming.
