The lawsuit filed against Silvercorp Metals Inc. by Kun Huang, a Vancouver man who claims that the company caused him to be wrongfully imprisoned in China, can go to trial, a judge in the Supreme Court of British Columbia has ruled. There are questions about whether Mr. Huang received a fair trial in China, the judge has found. There are also questions about whether Silvercorp was directing authorities.
The ruling, published on Thursday, Feb. 25, is a loss for Silvercorp, which had attempted to have the bulk of the case thrown out. The company contended that Mr. Huang was jailed entirely as a result of independent action by Chinese authorities. There was no indication that Silvercorp had anything to do with his time in custody. The company said that authorities had flagged his passport, resulting in his detention when he tried to leave China.
