Anthony Marsico, a Chicago-area man charged for insider trading ahead of a $413-million takeover offer for Canadian Securities Exchange listing Goodness Growth Holdings Inc. in 2022, has asked that the judge dismiss his indictment, citing misconduct by federal prosecutors. (All figures are in U.S. dollars.) He says that revelations of a scandal involving a grand jury in Chicago could extend to his case. As he sees things, the appropriate remedy is a complete dismissal.

The request comes as part of a case in which prosecutors charged Mr. Marsico, an insider at CSE listing Verano Holdings Corp., over his purchase of $1.5-million worth of stock ahead of a takeover offer that Verano made for Goodness Growth. He also tipped a group of golf friends on the takeover, the government said. Among other things, he allegedly told an associate that it was possible to "make a lot of money" on the deal.

The case has not yet gone to trial and, should Mr. Marsico have his way, it never will. In a motion filed on July 28, 2026, he asks that the judge review his case in light of a recent scandal at the federal courthouse in Chicago that is widespread across multiple investigations. In short, the scandal involves a federal prosecutor accused of improperly influencing a grand jury, the body that determines if there is sufficient evidence to file an indictment. Among other things, the prosecutor provided personal guarantees in lieu of evidence and had conversations with grand jurors outside of the courtroom, the motion states.
