The Globe and Mail reports in its Saturday edition that two months after cannabis producer SNDL was ordered to sell its network of several dozen cannabis stores in Ontario or risk having its licences revoked, the Edmonton-based company has still not publicly disclosed the regulatory challenge it is facing. The Globe's Jameson Berkow writes that in a "pre-enforcement notice" dated April 13, the Alcohol and Gaming Commission of Ontario told SNDL an investigation had determined the company holds "de facto control" of Spirit Leaf Ontario Inc. (SLOI) and Superette Ontario Inc. (SOI), meaning the company effectively has 46 cannabis stores in the province. Ontario law limits SNDL to owning a single "farmgate" retail location that must be operated on the same site as a production facility. Producers also cannot hold more than a 25-per-cent controlling interest in retail licence holders. "A proposal for a genuine, verified and complete divestiture of SNDL's de facto control of SLOI's and SOI's Ontario retail operations ... may provide a basis for an alternative resolution that addresses the substantive regulatory concern without the necessity of contested public proceedings," Jeff Longhurst, AGCO director said in the letter.
