The National Post reports in its Friday edition that months after Ottawa approved Rogers's takeover of Shaw -- on the premise that spinning off Shaw's mobile business to Quebecor would improve wireless competition -- Rogers is in court fighting the network access rates the CRTC ordered it to provide Quebecor. The Post's Anja Karadeglija writes that the court appeal by Rogers may hurt the CRTC's efforts to increase wireless competition. Expectations "that Rogers would play nice as a result of this merger, I think were unrealistic," said telco researcher Ben Klass. "The chickens are coming home to roost." In July, the CRTC set the "mobile virtual network operator" (MVNO) rates Quebecor will pay Rogers to use Rogers's cellular network. The regulator chose Quebecor's rate in final-offer arbitration. With the rates set, Quebecor was expected to start offering cell service in more areas across the country. Rogers is now fighting those rates, having filed an appeal of the CRTC's decision in the Federal Court of Appeal on Aug. 23. In a news release announcing the agreement for Quebecor to buy Shaw's Freedom Mobile, Rogers promised the deal would "ensure the presence and viability of a strong fourth wireless carrier in Canada."
