Battery X Metals Inc. is facing a lawsuit in the Supreme Court of British Columbia from privately held ATM Mining Corp., which claims that it was a victim of fraudulent misrepresentation. ATM Mining says that it invested money in Battery X in 2022 as part of an arrangement involving a mining property. ATM was to receive shares at 10 cents, but Battery X never issued the stock, the suit claims.

The allegations are contained in a notice of claim that ATM Mining filed at the Vancouver courthouse on July 29, 2026. The defendants are Battery X and one of the company's former directors, West Vancouver resident Daniel Cruz.

The case arises from an investment that Mr. Cruz solicited from ATM in June, 2022. According to the suit, he approached ATM and sought $50,000 for Battery X (then known as Straightup Resources Inc.). The money was to be used to secure the rights to a mining property in Eastern Canada and would be combined with a matching $50,000 from another person associated with the company, the suit states. As part of the transaction, ATM was to be issued shares at 10 cents in the next financing, according to the suit.
