The Court of Appeal for British Columbia has allowed a group of Eritreans to sue Nevsun Resources Ltd. in B.C. for mistreatment at the company's Bisha mine. Nevsun had challenged the case on jurisdictional grounds, contending that the matter should be heard in Eritrea, where the alleged wrongdoing occurred. Three appeal judges have disagreed, however, upholding an earlier ruling which determined that B.C. was an appropriate venue.
The decision comes as part of a 2014 lawsuit filed in B.C. by three former employees of the Bisha mine in Eritrea. The employees claim that they worked at the Bisha mine after being conscripted into a mandatory military service program. The men say that they worked in inhumane conditions that included the threat of torture if they refused to work. As they see it, Nevsun aided in their treatment and profited from it.
