John B. Good claims that on-line remarks he made about Vancouver promoter Robert Gardner were fair comment, and says they came after Mr. Gardner proposed a share transaction that would have broken securities rules. Mr. Good is responding to a defamation lawsuit he faces in the Supreme Court of British Columbia from Mr. Gardner. According to the suit, Mr. Good falsely accused Mr. Gardner of defrauding investors and of breaking securities laws.

Mr. Good, for his part, says his words were fair comment based upon true facts. He contends that Mr. Gardner had attempted to circumvent disclosure requirements in his dealings with a TSX Venture Exchange listing, GeoNovus Minerals Corp. Mr. Gardner had asked an associate, Leslie Rutledge, to create an offshore company that would have received GeoNovus shares. As Mr. Good sees it, the transaction would have broken rules that require companies to "disclose all material facts regarding share transactions they enter into."
