The Financial Post reports in its Friday, Aug. 28, edition that Kinder Morgan Canada will tell the National Energy Board on Friday how it plans to deal with evidence presented by Steven Kelly, the former consultant hired by Kinder to produce a study in support of its Trans Mountain pipeline expansion 18 months before being appointed to join the regulator. The Post's Claudia Cattaneo writes that Mr. Kelly's evidence was struck from the NEB record a week ago and imminent hearings to hear final arguments from the Enbridge rival as well 76 intervenors were called off. "There can be no question that public confidence in the impartiality of tribunal decision-makers is integral to the administration of justice," the panel said last week. "The dual role of Mr. Kelly ... may raise concerns about the integrity of this hearing process." In the statement, panel members David Hamilton, Philip Davies and Alison Scott said they do not know Mr. Kelly personally, that he does not start his NEB job until Oct. 13 and that he will not be involved in the Trans Mountain proceedings. One tree hugger says the "Prime Minister's office is manipulating independent government processes to forward their own political agenda."
