A judge in the Supreme Court of British Columbia has turned down National Bank Financial Inc.'s request for an injunction against former employee Dwight Mann and his group. The firm had sought a court order that would have prevented Mr. Mann from soliciting its clients. The judge declined to grant that injunction, ruling that brokerage houses do not "own" their clients, among other things.
The ruling is part of a case that arose after National Bank fired Mr. Mann on April 18, 2018. Mr. Mann almost immediately began working at Canaccord Genuity Corp., as did several people who worked in his group. Most of National Bank's complaint had to do with subsequent efforts by Mr. Mann and his associates to move the group's $725-million book of business. National Bank said that Mr. Mann was using confidential client information. It also claimed that a term of his employment barred him from soliciting National Bank clients for one year after he left. National Bank asked for an injunction to prevent the solicitations.
