Lomiko Metals Inc.'s chief executive officer, Amrit Paul Gill, has won an order in the Supreme Court of British Columbia directing Stockhouse Publishing Ltd. to release identifying information for a forum user known as "TruthDigger." Mr. Gill complained that somebody using that alias wrongfully accused him of fraud. He is seeking to trace the post back to its author.
A judge granted Mr. Gill's request in an order handed down on Aug. 24, 2018. The order is not likely to result in Mr. Gill immediately identifying the user, but there are electronic fingerprints that could help him in that regard. The judge's order includes a term directing Stockhouse to reveal the user's IP address. That address is a unique identifier that usually can be traced, through an Internet provider, to the residence, business or mobile device from which the post originated. Assuming he is successful in locating the user, Mr. Gill could then begin legal action or, more likely, extract an apology.
