The wrongful detention case that Kun Huang filed against Silvercorp Metals Inc. is continuing at a highly litigious pace, with a ruling handed down Friday in the Supreme Court of British Columbia showing just how entrenched both sides are. The parties required a 30-paragraph decision from a judge to determine the location and the duration of a normally routine matter, examinations for discovery. The judge has ruled that Silvercorp chief executive officer Rui Feng must come to Vancouver (he resides in Beijing) and must make himself available for five days.
The case has already featured many applications and motions, as well as an appearance before the Court of Appeal. Details of the latest application are contained in a decision released on Friday, April 29. As part of the ordinary pretrial process, Mr. Huang's lawyer had sought to interview Silvercorp's Mr. Feng in Vancouver. The time estimate was five days.
