A group of Alberta dissidents trying to replace the board of St. Elias Mines Ltd. will not be able to present a full slate of nominees after a court ruling. A judge has denied a petition the dissidents filed in the Supreme Court of British Columbia seeking to add James Rainbird and Richard Defreitas to their dissident slate.
The judge ruled against the dissidents after St. Elias contended that the addition of the two nominees came too late. In a response to the petition filed Dec. 18, the company said that its rules require all dissident nominees to file a consent to serve as a director 35 days prior to the annual general meeting. The company's AGM is scheduled for Dec. 27, but two of the dissidents did not file the forms until Nov. 26.
