Aly Nazerali, the plaintiff in a libel trial against the Deep Capture website, returned to the stand Thursday morning to continue his cross-examination by defence lawyer Roger McConchie, who picked up Tuesday's line of questioning about an injunction that temporarily shut down the website in 2011. Mr. McConchie quizzed Mr. Nazerali about several of the terms used in the affidavit that supported the injunction application.
The testimony is part of a lawsuit that Mr. Nazerali is pursuing against Deep Capture, Patrick Byrne, Mark Mitchell and others over 21 chapters that appeared on the website in 2011. Mr. Nazerali complains that the chapters falsely accuse of him of running scams, dealing weapons, associating with terrorists and Mafiosi, and more. Mr. Mitchell wrote the chapters and Mr. Byrne runs the website. Mr. Byrne also runs on-line retailer Overstock.com Inc., another defendant in the case.
Mr. Nazerali began his lawsuit on Oct. 19, 2011, the same day on which he separately sought an injunction to shut the website down. The injunction was granted and remained in effect until Dec. 2, 2011, when a court decided against renewing it.
