Imperial Metals wins order against Red Chris blockaders

Imperial Metals Corp. has won an injunction in the Supreme Court of British Columbia against blockaders who were attempting to stop the company from accessing its Red Chris mine. A judge has found that the blockaders engaged in "deliberate and unlawful conduct" intended to harm Imperial Metals and its business operations. Instead of using the consultation process, they resorted to illegal means to stop the company, the judge has ruled.

The order, handed down by Justice Robert Punnett on Thursday, Dec. 18, replaces a temporary injunction the company won on Oct. 9 against the group. It bars them from blocking access to the Red Chris mine. The order includes an RCMP enforcement clause that authorizes the arrest and removal of any blockaders. The decision follows a two-day hearing that took place in Terrace.

In ruling against the blockaders, Justice Punnett found that they represented a small group of Tahltan who disagreed with the decisions of the Tahltan Central Council. The council has been heavily involved in the mine, having entered agreements with the various companies that have been developing Red Chris since 2007. The duties of Tahltan companies include running the camp at the mine, and band members comprise about 100 of the mine's 824 employees.
