Companies in the newly legitimate industry of marijuana production are coming up with names for their brands, drawing from everyday phrases to puns. As they attempt to establish their brand names, they are staking claims on those phrases and puns as intellectual property. For instance, Sebastien St-Louis and Adam Miron's licensed marijuana producer, The Hydropothecary Corp. (THCX: $2.32), has applied to register trademarks for the following phrases, which it uses as brand names for its marijuana strains: Good Morning, Midday, After Dinner and Bedtime. The trademark applications have been allowed by the Canadian Intellectual Property Office (CIPO), which means that all the company needs to do now are file a declaration of use and pay a registration fee of $200 for each trademark, then it would hold the trademark for 15 years. The Hydropothecary's trademarks do not cover everyday use of the phrases; they cover the use of the phrases in relation to medical marijuana products and accessories, such as marijuana capsules, skin patches, brownies, marijuana-infused non-alcoholic drinks, rolling papers and vaporizers. To protect the company's advertising and sales efforts, the trademarks also cover the use of the phrases in printed and electronic publications, as well as during seminars and other events, which provide information on medical marijuana benefits and laws.
