The Law Society of British Columbia has found controversial Vancouver securities lawyer John Briner guilty of professional misconduct. A hearing panel has determined that he misappropriated $50,439 in client money and failed to co-operate with a subsequent investigation the society pursued against him over that missing money. The society has not yet determined what Mr. Briner's penalty will be.
The findings are contained in a ruling dated March 31, 2015. They stem from problems with one of Mr. Briner's clients, who the Law Society's ruling only identifies as GK. Mr. Briner represented GK with respect to a loan in late 2012. The ruling does not state the purpose of the loan or who the recipient was, but it does say that Mr. Briner received $50,439 in his trust account on Dec. 20, 2012, that he was supposed to hold for the client. The problem, as described in the decision, is that Mr. Briner did anything but hold the money. Instead he transferred some to his law firm's general account, allocated some to another client and transferred out other amounts.
