The Financial Post reports in its Friday edition the NFL filed documents with the Federal Court of Appeal this week, requesting intervenor status in BCE's appeal of the CRTC's January decision to ban the commercial-swapping practice known as simsub during the Super Bowl. The Post's Claire Brownell writes the NFL wants the court to strike down the CRTC's ban on the grounds that it was unreasonable and made without the proper jurisdiction. "The CRTC lacked an intelligible justification to single out the Super Bowl," the NFL's motion said. "It treated the Super Bowl as a separate class of programming unto itself, for which U.S. advertising is 'integral,' without any justification for why U.S. advertising is not also integral to other League games or other highly rated American programs such as the Oscars." The NFL stands to lose revenue from Canadian broadcasters which might buy the rights, but will now have to compete with U.S. signals here showing the same game but with flashier American commercials. The Super Bowl was watched at least in part by 19.3 million Canadians this year. In March, BCE's Bell Media filed a motion to appeal the ban, arguing the CRTC unfairly discriminated against the company.
