Glen Landry, a geologist fighting charges from the U.S. Securities and Exchange Commission for the promotion of Norstra Energy Inc., has lost an unusual attempt to expand the case. A New York judge has turned down his request to add another defendant. Mr. Landry had claimed that a man named Dallas Kerkenezov (a Norwegian citizen who once lived in Canada) should have been part of the litigation. The judge, however, has ruled that the SEC is free to decide the subjects of its enforcement actions.
The ruling comes as part of a civil case the SEC has been pursuing against Mr. Landry for the 2013 manipulation of Norstra Energy, a purported Texas oil explorer with B.C. connections. The SEC claims that Mr. Landry and a newsletter writer named Eric Dany boosted Norstra to $2.06 from 35 cents. (All figures are in U.S. dollars.) The men touted the company as having access to millions of barrels of oil when it did not, the SEC says.
