Van Sun says BCSC, SEC target faces new allegations

The Vancouver Sun reports in its Saturday edition a former Howe Street securities lawyer John David Briner faces new charges under the B.C. Securities Act for failing to abide by the conditions of a previous ban. The Sun's Derrick Penner writes Crown filed a nine-count criminal information against Mr. Briner on March 17 alleging that between 2011 and 2014 he did not resign positions he held with three companies, and took up positions with six others while he was banned from doing so. Three of those companies are linked to allegations filed against Mr. Briner on Jan. 15 by the U.S. Securities and Exchange Commission. The SEC alleges during the same period he orchestrated "a scheme to create sham public shell companies." The SEC identifies 10 other participants and lists 20 of the allegedly fake junior mining companies, referring to "Briner's shell factory." He last appeared in Provincial Court on April 16, where the matter was adjourned to May 11 for a hearing to set a trial date for the Securities Act allegations. Mr. Briner's ban from the market stems from 2009 SEC charges against him alleging he was involved in the pump-and-dump stock-price manipulation of a pink sheet flyer called Golden Apple Oil.
